Welcome to Street Feasts. These Terms of Service ("Terms") govern your access to and use of the Street Feasts website, applications, and services (the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Definitions

• "Platform" refers to the Street Feasts website, mobile applications, and all related services.
• "Vendor" refers to any food truck, food trailer, or tented food vendor who creates a business profile on the Platform.
• "Customer" refers to any user who uses the Platform to discover, follow, or interact with Vendors.
• "User" refers to any individual or entity that accesses or uses the Platform, including Vendors and Customers.
• "Content" refers to text, images, menus, photos, reviews, and any other material posted on the Platform.

2. Eligibility

You must be at least 18 years old to create an account on the Platform. By registering, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are creating an account on behalf of a business, you represent that you have the authority to bind that business to these Terms.

3. Account Registration

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Vendor-Specific Terms

4.1 Vendor Profiles

Vendors are responsible for the accuracy of all information in their profile, including business name, menu items, pricing, photos, and operating details. Misleading or false information may result in profile suspension or removal.

4.2 Location Sharing

When you use the "Go Live" feature, your real-time location is displayed publicly on the Street Feasts map. You are solely responsible for ensuring that you have the necessary permits, licenses, and permissions to operate at any location you broadcast. Street Feasts does not verify vendor locations or operating permits.

4.3 Subscriptions and Payments

Certain features of the Platform require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our Pricing page. Subscription fees are billed in advance on a recurring basis (monthly or annually). You may cancel your subscription at any time, but refunds are not provided for partial billing periods. We reserve the right to change subscription pricing with 30 days' notice.

4.4 Compliance with Laws

Vendors are solely responsible for complying with all applicable federal, state, and local laws, regulations, and ordinances related to food preparation, food safety, business licensing, health permits, and mobile vending. Street Feasts is a technology platform and does not assume any liability for vendor compliance.

5. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Post false, misleading, or fraudulent content
• Impersonate another person or business
• Interfere with or disrupt the Platform or its infrastructure
• Scrape, harvest, or collect data from the Platform without authorization
• Use automated systems (bots, scrapers) to access the Platform
• Harass, abuse, or threaten other Users
• Upload content that infringes on intellectual property rights
• Attempt to gain unauthorized access to other accounts or systems

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of the content you post on the Platform. By posting content, you grant Street Feasts a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the Platform. This license ends when you delete your content or close your account.

6.2 Our Content

The Platform, its design, features, and all associated content (excluding User-generated content) are owned by Street Feasts and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content without written permission.

7. Catering Services

Street Feasts may facilitate connections between Customers seeking catering and Vendors who offer catering services. Street Feasts acts solely as an intermediary and is not a party to any agreement between a Customer and a Vendor for catering services. Any disputes regarding catering arrangements are between the Customer and the Vendor.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. STREET FEASTS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR THE QUALITY, SAFETY, OR LEGALITY OF ANY VENDOR'S FOOD, SERVICES, OR BUSINESS PRACTICES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREET FEASTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO STREET FEASTS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Street Feasts, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your content; or (d) for Vendors, your food preparation, business operations, or compliance with applicable laws.

11. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. You may close your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and indemnification) will survive.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms. If you do not agree with the changes, you should stop using the Platform.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of [Your State], without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Street Feasts regarding your use of the Platform and supersede all prior agreements and understandings.
